Terms and Conditions
§ 1 Scope — These Terms and Conditions apply to all contracts between VIDISTRY24 and the customer for the creation of individual cinematic videos.
§ 2 Conclusion of contract — The contract is concluded only when payment has been received, all files have been fully uploaded, and the order has been accepted by us.
§ 3 Description of services — Individual custom production based on photos provided by the customer; not a standard product.
§ 4 Prices and payment — The prices stated at the time of ordering apply. Payment is processed via Stripe.
§ 5 Customer cooperation obligations — Complete and timely uploads, correct information, sufficient image quality, lawful use of the content, and timely responses to follow-up questions.
§ 6 Image rights — The customer confirms that they have the right to use the uploaded photos and indemnifies us against third-party claims.
§ 7 Rejection of orders — We may reject orders involving unlawful content, including copyright infringement, trademarks, extremism, discrimination, pornography, glorification of violence, or criminal content.
§ 8 Delivery time — 1 to 3 business days after full receipt of payment and upload; this may be extended in cases of high workload, technical issues, force majeure, or incomplete information.
§ 9 Delivery — Delivery is made exclusively via a secure download link by email.
§ 10 Revisions — One revision round is included in the price, relating to the agreed content; further changes may be subject to additional charges.
§ 11 Quality of final products — We are not liable for quality losses caused by blurry, low-resolution, compressed, or damaged customer photos.
§ 12 Storage — Project files are stored for 30 days and deleted afterwards.
§ 13 Use as reference — Only with the customer’s express consent.
§ 14 Right of withdrawal — Consumers generally have the statutory right of withdrawal. Details are set out in the separate withdrawal policy. If the customer expressly requests that VIDISTRY24 begin processing the order before the withdrawal period has expired, and the customer simultaneously confirms that they are aware that their right of withdrawal may expire prematurely under the statutory conditions, performance will be carried out in accordance with the statutory provisions. The statutory rules regarding exclusion or premature expiry of the right of withdrawal, particularly for individually produced services or digital content, remain unaffected.
§ 15 Liability — Unlimited liability applies in cases of intent, gross negligence, and under the Product Liability Act; in cases of slight negligence, liability applies only for breaches of essential contractual obligations and is limited to foreseeable damage.
§ 16 Applicable law — German law applies; the UN Convention on Contracts for the International Sale of Goods is excluded.
§ 17 Final provisions — Severability clause.
